Please note: This role is onsite at either Cartersville, GA or secondary office in Norcross, GA.
SUMMARY
The Legal Counsel role will be responsible for providing in-house legal advice and guidance on a wide range of corporate matters, including contracts, employment law, customs and trade law, and compliance. The Legal Counsel will assist in the resolution of disputes and manage litigation/arbitration, while reviewing and interpreting legal requirements and effectively communicating these to the business/external stakeholders. This position reports to the Sr. Legal Counsel.
RESPONSIBILITIES
- Provide legal support and guidance to the business team and management on a variety of legal issues.
Provide expert legal advice on all aspects of U.S. and global immigration law, including visa petitions, green cards, and naturalization.
Manage and oversee the company's immigration program, ensuring compliance with USCIS, Department of Labor (DOL), and Department of State regulations.- Counsel human resources and management on a wide variety of employment-related matters, including hiring, disciplinary actions, terminations, and employee relations.
- Manage and direct employment-related litigation, working with outside counsel as needed.
- Manage and resolve legal disputes, including disputes with commercial parties.
- Investigate and respond to internal and external complaints, including those filed with the EEOC, DOL, and state fair employment agencies.
- Ensure compliance with local, state, and federal laws and regulations.
- Provide supervision to outside lawyers hired to assist the company with their specialized legal services.
- Draft, review, and negotiate contracts and other legal documents, including purchase agreements, sales agreements, service agreements, and lease agreements.
- Design, build, and improve legal team processes.
- Consult and protect Qcells against legal risks, penalties, and investigations.
REQUIRED QUALIFICATIONS
- Juris Doctor (JD), Master of Laws (LLM), or an equivalent degree from an accredited law school.
- A member in good standing with a state bar association.
- 1-3 years of experience as in-house counsel or at a law firm (or a combination of both). Professional legal experience handling legal disputes such as litigation and arbitration.
PREFERRED QUALIFICATIONS
- 3+ years of experience as in-house counsel or at a law firm (or a combination of both).
- Expertise or focus in employment or immigration law.
- Bilingual (Korean & English).
- Experience in the solar industry, energy sector, or manufacturing industry.
