Please note: This role is onsite at either Cartersville, GA or secondary office in Norcross, GA.

SUMMARY

The Legal Counsel role will be responsible for providing in-house legal advice and guidance on a wide range of corporate matters, including contracts, employment law, customs and trade law, and compliance. The Legal Counsel will assist in the resolution of disputes and manage litigation/arbitration, while reviewing and interpreting legal requirements and effectively communicating these to the business/external stakeholders. This position reports to the Sr. Legal Counsel.

RESPONSIBILITIES
  • Provide legal support and guidance to the business team and management on a variety of legal issues.

  • Provide expert legal advice on all aspects of U.S. and global immigration law, including visa petitions, green cards, and naturalization.

  • Manage and oversee the company's immigration program, ensuring compliance with USCIS, Department of Labor (DOL), and Department of State regulations.
  • Counsel human resources and management on a wide variety of employment-related matters, including hiring, disciplinary actions, terminations, and employee relations.
  • Manage and direct employment-related litigation, working with outside counsel as needed.
  • Manage and resolve legal disputes, including disputes with commercial parties.
  • Investigate and respond to internal and external complaints, including those filed with the EEOC, DOL, and state fair employment agencies.
  • Ensure compliance with local, state, and federal laws and regulations.
  • Provide supervision to outside lawyers hired to assist the company with their specialized legal services.
  • Draft, review, and negotiate contracts and other legal documents, including purchase agreements, sales agreements, service agreements, and lease agreements.
  • Design, build, and improve legal team processes.
  • Consult and protect Qcells against legal risks, penalties, and investigations.


REQUIRED QUALIFICATIONS
  • Juris Doctor (JD), Master of Laws (LLM), or an equivalent degree from an accredited law school.
  • A member in good standing with a state bar association.
  • 1-3 years of experience as in-house counsel or at a law firm (or a combination of both).
  • Professional legal experience handling legal disputes such as litigation and arbitration.


PREFERRED QUALIFICATIONS
  • 3+ years of experience as in-house counsel or at a law firm (or a combination of both).
  • Expertise or focus in employment or immigration law.
  • Bilingual (Korean & English).
  • Experience in the solar industry, energy sector, or manufacturing industry.
